Confidential Business Questionnaire (CBQ): how to fill it
The CBQ ("Tenderer's Eligibility – Confidential Business Questionnaire") tells the procuring entity who owns your business and whether there is any conflict of interest. It is mandatory in almost every Kenyan tender, and tenders often ask that it be "duly filled, signed and stamped" — sometimes also matching your CR12.
Part (a) – Tenderer's details
- Name of the procuring entity, tender reference number, date and time of opening.
- Your full name and address: country, city, location, building, floor, postal address, contact person and email.
- Trade licence / business permit number and its expiry date — make sure it is still valid on the closing date.
- Registering body (for most firms: Business Registration Service, Kenya), nature of business, maximum value of business you handle, and whether you are listed on a stock exchange.
Part (b) – Ownership
- Sole proprietor: full name, age, nationality, country of origin, citizenship.
- Partnership: partners with nationality, citizenship and % shares.
- Limited company: private or public, nominal and issued capital, and every director with nationality, citizenship and % shares. These must match your CR12.
Parts (c)–(d) – Interest and conflicts
State whether anyone in the procuring entity has an interest in your firm. Then answer the conflict-of-interest table (9 questions) with YES or NO and details for any YES. For a firm with no links to the entity or other bidders, the answers are NO, and the last question (about resolving such conflicts) is "N/A".
Part (e) – Certification
Full name, title, signature and date of the authorised person, plus your stamp. Giving false information on this form is an offence.
Checks before you submit
- Directors and shares = CR12 (tenders often want a CR12 issued in the last 6–12 months).
- Permit number and expiry filled in.
- Signed, stamped, dated, on letterhead if the tender asks.
