SD1 and SD2 self-declaration forms

Kenyan tenders ask for two self-declarations under the Public Procurement and Asset Disposal Act, 2015. They are short, but they are usually mandatory and many bids fail on them: unsigned, unstamped, wrong tender number, or only one of the two attached.

Form SD1 – not debarred

Declares that your firm, its directors and subcontractors "have not been debarred from participating in procurement proceeding under Part IV of the Act." Fill in: your name, P.O. Box, town of residence, your title (e.g. Director), company name, tender number, tender name and procuring entity. Then title, signature, date and stamp.

Form SD2 – no corrupt or fraudulent practice

Declares that the bidder will not engage in corrupt or fraudulent practice, has not been asked to pay and has not offered any inducement to the entity's board, management or staff, and will not engage in collusive practice with other bidders. Same details as SD1, with the entity's name filled in each place it is asked.

Also often required: SD3 / Code of Ethics

Many tenders add a "Declaration and Commitment to the Code of Ethics for Persons Participating in Public Procurement and Asset Disposal", sometimes called SD3. It needs the signatory's name, position, office address, phone, email, firm name, date, stamp and a witness.
